Understanding Copyright Scents and Signature Formulas

This is an important and valuable question for anyone entering the perfume industry or looking to build their own fragrance brand. Many people may not fully understand whether a perfume formula can be considered intellectual propertyor how to know which formulas are safe to use and which ones are off-limits.

1. Can a Perfume Formula Be Owned?

Yes, but not in the same way as a book or painting.

In the perfume industry, scent formulas (like the ratio of various essential oils) are usually protected as trade secrets rather than through copyright or patents. Why? Because filing a patent requires full public disclosurewhich is not ideal for fragrance brands.

Most major brands like Dior or Chanel keep their signature formulas strictly confidential. Even OEM (Original Equipment Manufacturer) factories often create exclusive formulas for each brand and prohibit reuse for others.


2. How Do You Know if a Scent Formula Is Already Owned?
If you're working with an OEM/ODM factory, ask them. Is this formula exclusive to my brand?

For more common scents like Lavender, Ocean, or Bubble Gum, the formula may be available to multiple brands.

But if you commission a custom formula, make sure to sign a contract stating the formula belongs to you alone.
